TERMS OF USE:

This Agreement, sets forth the terms and conditions that apply to the use of Arcadia Hosting services by its customers.  By using Arcadia Hosting the customer agrees to comply with all of the terms and conditions hereof. The right to use Arcadia Hosting is personal to the customer and is not transferable to any other person or entity. 

CUSTOMER CONDUCT
• Customer shall use our services for lawful purposes only. Any conduct by said customer that in Arcadia Hosting’s discretion restricts or inhibits any other user from using or enjoying our services will not be permitted.
• Services contain copyrighted material, trademarks and other proprietary information and the entire contents of our services are copyright protected as a collective work under United States copyright laws. Customer may not change, transmit, publish, create illegal works, or in any way exploit, any of the content, in whole or in part. Copyrighted material may be downloaded for the customer's personal use only. Except as expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Arcadia Hosting.   In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. Customer acknowledges that it does not acquire any ownership rights to downloaded copyrighted material.
• Customer shall not use or permit or facilitate others to use the service by any automated electronic processes or any computer programs that monitor, copy or download data or other content found on or accessed through the website service.
• Customer is solely responsible for any content they create, transmit or display while using our services and for any consequences of such actions.
• Customer acknowledges and agrees that Arcadia Hosting owns all legal rights, title and interest in and to our services. Nothing herein gives the customer the right to the use of Arcadia Hosting's name, trademarks or logos.

CHANGES

Arcadia Hosting reserves the right to, at any time, change or modify the terms and conditions applicable to the customer’s use of our service. Any changes shall be effective immediately upon notice thereof.


LIMITS OF LIABILITY

Arcadia Hosting or any person involved in creating, producing or distributing our services will be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use the services.

TERMINATION

This agreement can be terminated by either Arcadia Hosting or the customer at any time.

This Agreement constitutes the entire agreement of the parties with respect to the subject matter hereof, and supersedes all previous agreements between the parties with respect to such subject matter.
